Chapter 5 is comprised of the general principles on transparency, equal treatment, free competition and non-discrimination in public procurements.

Specific EU rules apply to coordination of the award of public contracts for works, services and supplies, for traditional contracting entities, and for special sectors. Moreover, the acquis specifies rules for review of procedures and availability of legal remedies.

Public procurements also cover the public-private partnerships and concession contracts. Projects on public-private partnership are aimed to respond to particular public need, i.e. they are aimed to provide public service falling within competences of certain public authority. Specialised bodies at national level are required to implement policies covered by this chapter.
